Many Nepali couples never register their marriage — and for years, nothing goes wrong. The problems surface at the worst possible moments: a visa application, a hospital, an insurance claim, an inheritance dispute or a divorce. Here is an honest look at what actually goes wrong without marriage registration, and what does not.
The Core Problem: Proof
A marriage lawfully performed by social or religious custom is not automatically invalid merely because it was never registered. But without a government marriage registration certificate, the burden of proving the relationship, its date and the identities of the spouses becomes much heavier. What looks fine while there is no dispute becomes complicated during visa processing, inheritance, death, insurance or divorce.
Practical Problems That Arise
- Spouse/dependent visa, family reunion or foreign residence applications rejected for want of an official marriage certificate
- Bank nominee, joint accounts, insurance claims, pension or employee benefits requiring extra proof of the relationship
- Inheritance, property transfer, compensation or funeral processes where the relationship becomes disputed after a death
- Local family records, migration records and social security data not matching
- In court — domestic relationship, maintenance, partition or divorce cases — needing witnesses and photographs to prove the marriage happened
- Disputes about concealed marital status or bigamy when someone attempts a second marriage
- Surname or relationship inconsistencies across passport, National ID, tax, employment and immigration documents
These do not apply automatically to everyone. Outcomes depend on the institution, the nature of the dispute and what other evidence exists.
The Important Exception: Your Child’s Birth Registration
A missing marriage registration cannot block a child’s birth registration. Either parent may act as informant. Do not give false information out of fear that your child’s rights are at risk — see our guide for these situations. Disputed or unestablished paternity is a separate matter requiring its own evidence.
If Your Spouse Refuses to Register
Ward registration is simple when both cooperate. If one party denies the marriage or refuses to attend, preserve wedding photographs, invitations, witnesses, children’s records, joint residence evidence and any other proof. Departmental guidance allows one party to register on the basis of a court order establishing the marital relationship.
If a spouse died before registration, an ordinary ward marriage certificate may not be issued — seek legal advice about ward-chairperson certification or establishing the relationship through court.
Registering Late Is Still Possible
Passing 35 days does not close registration. With proof of a lawful marriage you can register late at the ward for the current Rs 200 fee. Questions about age, previous marital status or validity may trigger further checks. Late registration cannot validate a void child marriage or polygamous marriage.
What to Do Now
- Collect both citizenship certificates, photographs and any old evidence of the marriage date and place.
- Confirm the legal end of any previous marriage.
- Get the current checklist from the relevant ward office.
- After issuance, align names and dates with your other documents.
